【摘要】:1.1PurposeThepurposeofthispracticeistodefinegoodcommercialandcustomarypracticeintheUnitedStatesforconductinganenvironmentalbaselinesurvey(EBS)inordertodeterminecertainelementsoftheenvironmentalconditionoffederalrealproperty,includingexcessandsurpluspropertyatclosingandrealigningmilitaryinstallations.ThiseffortisconductedtofulfillcertainrequirementsoftheComprehensiveEnvironmentalResponse,CompensationandLiabilityActof1980(CERCLA)section120(h),asamendedbytheCommunityEnvironmentalResponseFacilitationActof1992(CERFA).Assuch,thispracticeisintendedtohelpausertogatherandanalyzedataandinformationinordertoclassifypropertyintosevenenvironmentalconditionofpropertyareatypes(inaccordancewiththeStandardClassificationofEnvironmentalConditionofPropertyAreaTypes).Oncedocumented,theEBSisusedtosupportFindingsofSuitabilitytoTransfer(FOSTs),FindingsofSuitabilitytoLease(FOSLs),oruncontaminatedpropertydeterminations,oracombinationthereof,pursuanttotherequirementsofCERFA.Usersofthispracticeshouldnotethatitdoesnotaddress(exceptwhereexplicitlynoted)requirementsforappropriateandtimelyregulatoryconsultationorconcurrence,orboth,duringtheconductoftheEBSorduringtheidentificationanduseofthestandardenvironmentalconditionofpropertyareatypes.1.1.1EnvironmentalBaselineSurveyInaccordancewiththeDepartmentofDefense(DoD)policy,anEBSwillbepreparedorevaluatedforitsusefulness(andupdatedifnecessary)foranypropertytobetransferredbydeedorleased.TheEBSwillbebasedonexistingenvironmentalinformationrelatedtostorage,release,treatment,ordisposalofhazardoussubstancesorpetroleumproductsonthepropertytodetermineordiscovertheobviousnessofthepresenceorlikelypresenceofareleaseorthreatenedreleaseofanyhazardoussubstanceorpetroleumproduct.Incertaincases,additionaldata,includingsampling,ifappropriateunderthecircumstances,maybeneededintheEBStosupporttheFOSTorFOSL.ApreviouslyconductedEBSmaybeupdatedasnecessaryandusedformakingaFOSTorFOSL.AnEBSalsomayhelptosatisfyotherenvironmentalrequirements(forexample,tosatisfytherequirementsofCERFAortofacilitatethepreparationofenvironmentalconditionreports).Inaddition,theEBSprovidesausefulreferencedocumentandassistsincompliancewithhazardabatementpoliciesrelatedtoasbestosandlead-basedpaint.TheEBSprocessconsistsofdiscretesteps.ThispracticeprincipallyaddressesEBS-relatedinformationgatheringandanalysis.1.1.2CERCLASection120(h)RequirementsThispracticeisintendedtoassistwiththeidentificationofinstallationareassubjecttothenotificationandcovenantrequirementsofCERCLA120(h)relatingtothedeedtransferofcontaminatedFederalrealproperty(42USC9601etseq.).1.1.3CERFARequirementsThispracticecanbeusedtoprovideinformationthatcanbeusedtopartiallyfulfilltheidentificationrequirementsofCERFA[Pub.L.102-426,106Stat.2174],whichamendedCERCLA.PropertyclassifiedasareaType1,inaccordancewithClassificationD5746iseligibleforreportingas"uncontaminated"undertheprovisionsofCERFA.Additionally,certainpropertyclassifiedasareaType2,whereevidenceindicatesthatstorageoccurredforlessthanoneyear,mayalsobeidentifiedasuncontaminated.AtinstallationslistedontheNationalPrioritiesList,EnvironmentalProtectionAgency(EPA)concurrencemustbeobtainedforthepropertytobeconsidered"uncontaminated"andthereforetransferableunderCERCLA120(h)(4).TheEPAhasstatedthattheremaybeinstancesinwhichitwouldbeappropriatetoconcurwiththeDoDComponentthatcertainpropertycanbeidentifiedasuncontaminatedunderCERCLA120(h)(......
